"Jak 3 Contest" RULES AND REGULATIONS

How to Enter:

No purchase necessary. Contest open to all residents of Canada, except residents of Quebec and those noted below. To enter, contestants must go online and complete the Jak 3 Contest ballot at www.accessmag.com/Contests/Jak3.html.

Eligibility:

•  To be eligible, entries must be received by December 31 2004 11:59 PM Eastern time (the "Entrance Deadline"). Odds of winning depend on the number of eligible entries received.

•  Prizes must be accepted as awarded, without substitution and are not transferable or convertible to cash. Access Magazine and PlayStation® 2 (the " Contest Sponsors") reserve the right at their sole discretion to substitute a prize of equal or greater value for any reason , including, but not limited to production delays caused by labour disruptions, product shortages, adverse weather conditions or other unforeseen events; and for any other reasons. By entering this contest, contestants agree, on behalf of themselves and their respective heirs, executors and administrators to release the Contest Sponsors and their respective affiliates, agencies and/or representatives from all liability, claims and demands arising out of participation in the contest or of the awarding or use of the prize described herein.

•  Each selected contestant is required to sign a standard release form to be eligible to win a prize. The contestant must have reached the age of majority in his/her province of residence. Contest is subject to all federal, provincial and local laws and regulations. Void where prohibited by law. Employees of the Contest Sponsors and their respective advertising and promotional agents, contest judging organization, prize suppliers, and the immediate family members and all persons with whom any of the foregoing are domiciled are not eligible to enter the contest.

•  By entering the contest, winners and participants agree to be bound by these contest rules and regulations and the decision of the Contest Judges, which are final.   By entering the contest, each contestant consents to the use of their name, image, voice, likeness, city of residence, and/or photographs without compensation in any publicity or advertising carried out in any medium by the Contest Sponsors and/or their respective agencies without further notification.

The Prizes :

One of five Jak 3 PlayStation® 2 games. The approximate retail value of each prize is $49.99.

Prizes may not be exactly as shown in contest publicity or promotional materials and the Contest Sponsors reserve the right to substitute prizes. All incidental costs and expenses not specifically referred to shall be the responsibility of winner.

The Draw:

A random draw will take place by the independent contest organization (the "Contest Judges") on Tuesday, January 4 2005 at approximately 1:00pm in Toronto, Ontario from among all eligible entries received by the Entrance Deadline. The first five names drawn will be eligible to win a prize. The selected entrants will be contacted via email or by phone or mail within 3 business days after the draw using the contact information they provided when they entered the contest. If the selected entrant cannot be contacted within 14 days of the draw or, if contacted, does not reply within the 14 days of being emailed or contacted by phone or by mail, or does not meet all of the eligibility conditions described in these rules and regulations, he/she will not be eligible to win the prize and another randomly selected entrant will be chosen and contacted.

In order to win, the selected entrant must correctly answer, unaided, a time-limited mathematical skill testing question. Selected contestants must sign a standard release form (i) confirming compliance with and agreeing to be bound by these contest rules and regulations (ii) releasing the Contest Sponsors, their directors, officers, dealers, partners and employees from any and all liability, claims and demands arising out of participation in the contest or of the awarding or use of the prize described herein, and (iii) consent to the use of their name and/or photograph in any publicity carried out by the Contest Sponsors or their agents without compensation.

General:

Contest Sponsors reserve the right to cancel, terminate or suspend this contest in whole or in part if for any reason the contest is not capable of running as planned. In such event, a winner may be selected by randomly drawing from among all valid entries received up to such time of cancellation termination or suspension.
